PRESERVE or OBLITERATE CONSTITUTIONAL SEPARATION OF POWERS?

With great concern, I am watching the race/battle between those who seek to PRESERVE the Constitutional separation of powers and those who strive to OBLITERATE it. Alarmingly-strong forces are seeking to concentrate all power in the hands of Trump and the Executive Branch.

It’s bizarre to see so few (essentially none) Republican representatives or senators standing up to preserve Congress’ legislative power, power of the purse, and power to create and mandate federal agencies.

Robert Kuttner has an excellent article about the impending Government Shutdown Battle. Kuttner asks the essential question: "Will the Democrats have the savvy and unity to outplay Trump?"

https://prospect.org/blogs-and-newsletters/tap/2025-03-07-impending-government-shutdown/

Also worthwhile at The American Prospect is their Weekly Roundup. Harold Meyerson and Adam Serwer of The Atlantic analyze the early days of the second Trump term.

DEMOCRATS MUST EXTRACT CONCESSIONS

Trump is blatantly impounding funds that have been allocated by Congress – a power he does not have. (Presidential impoundment authority was eliminated during Nixon’s reign.) Likewise Trump & Musk are essentially neutering or even eradicating agencies created by Congress and past administrations. (Again, a power they do not have.)

But this matters only if the Supreme Court orders Trump to cease and desist, or if Congress resists. The ongoing Budget / Shutdown battle is probably Democrats’ best shot at extracting meaningful concessions. Imho, these concessions must include:

1) That funds allocated by Congress shall be spent as specified.

2) That the eradication/neutering/mass firing at agencies Trump & Musk don’t like be halted and reversed.

#1 must include e.g. USAID, IRS, aid to UKRAINE…

An opposition party in Congress seeking to preserve the constitutional balance of powers would be issuing articles of impeachment against a chief executive violating that balance. Otherwise, wringing hands and bemoaning what's happening is mostly all hot air.

Expand full comment
ArcticStones's avatar

Neither Kuttner nor I approve of hand-wringing and bemoaning – quite the contrary. Which is why Democrats need to stand united and play hardball.

On the other hand, an impeachment effort would be merely performative and a waste of time, resources and political capital. Moreover, it is a distraction.

Expand full comment
Thomas's avatar

How much does it cost to file an article of impeachment? How much in the way of resources does it require?

I don't regard our constitution as a performative document. Or a distraction.

Impeachment is the very remedy set up by our framers.

It is only a waste of time to those who do not regard the constitution.

Visualize the WH mail room: On March 15, many people will mail Donald Trump a postcard that publicly expresses our opposition to him. And we, in vast numbers from all corners of the world, will overwhelm the man with his unpopularity and failure. We will show the media and the politicians what standing with him—and against us—means. And most importantly, we will bury the White House and post office in pink slips, all informing Trump that he's fired.

Each of us—every protester from every March, each Congress calling citizen, every boycotter, volunteer, donor, and petition signer, if each of us writes even a single postcard and we put them all in the mail on the same day, March 15, well: you do the math.

No alternative fact or Russian translation will explain away our record breaking, officially-verifiable, warehouse-filling flood of fury. Hank Aaron currently holds the record for fan mail, having received 900,000 pieces in a year. We're setting a new record: over a million pieces in a day.

So sharpen your wit, unsheathe your writing implements, and let Donald Trump know what you think about his actions.

Spread the word. Everyone on earth should let Trump know how he's doing. They can't build a wall high enough to stop the mail.

Then on March 15, mail your messages to President Donald J Trump, the White House 1600 Pennsylvania Avenue NW Washington, DC 20500.

Yes! Enough pink slips to bury him, if all of us write just 1....or 5.....or......Here's what a friend put on hers - the front "Here Is Your Pink Slip " next to the address: the back "You're Fired! Please pack Your bags and LEAVE! Sincerely, the American People"

Feel free to use and pass on!

Use any postcard. It's the msg that's important and the numbers sent. Someone here posted that she would be using postcards from National Parks and writing something like "In order to save our National Parks......You're Fired!"

Of course, that ignited the thought that we could send a postcard of anything we want to save such as the Decl of Ind (those first words...) and repeat her phrase as a msg.."In order to save our/the (.....), You're Fired!"

Simon et al.:

With the latest activities of Dolos per the sale of Ukraine “down the river” (please understand this US Slavery reference), this interview (not quite 30 minutes) with Malcolm Nance by Ukraine’s “Kyiv Independent” is extremely timely: https://www.youtube.com/watch?v=8cjIggQwUHQ&list=TLPQMDcwMzIwMjWlUfov7dkB8A. The money quote is “Russia is a trailer park with atomic bombs”; according to some of my associates, outside of Moscow and St. Petersburg, this is the truth (smile). For a similar perspective from an academic and specialist on Russia, this recent episode from “Silicon Curtain” is a sobering view on the USA from abroad: https://www.youtube.com/watch?v=_wzJX-ogA9M .

As I’ve suggested previously, everyone should read the works of Nance, a former intelligence operative. He always brings the receipts: https://www.sbs.com.au/news/article/why-did-czech-communist-secret-police-have-a-dossier-on-donald-trump/lwekp32yv. His observations are now more “on-point” than ever!

Here is a 50-minute (use 1.5x speed) take on Russian propaganda from a Russian with a strong background in communications (at timestamp 32:33 think of Dolos with three marriages plus numerous affairs and Leon with fourteen children by four or five different women): https://www.youtube.com/watch?v=kyXfbM-kTP8&list=TLPQMDgwMzIwMjXVqDHBaoKK_Q. It is a tired history. Unfortunately, she skips the Mongol terror, but THIS ACCOUNT IS EXTREMELY RELEVANT TO OUR PRESENT.

Finally, while I was on the road last week, I made sure to call my all-Republican delegation. As usual, I was only able to leave VMs for my Senators (this lack of contact has been consistent). Yet, on occasion, I did get to speak with a young staffer for my Representative. With all of the PREDICTABLE MISHEGOSS relative to tariffs, my concerns about their obviously damaging economics have gained some recent currency with my politicos.

CARTHAGO DELENDA EST (via nonviolence).

P.S.: Do the following now! FIRST, TEACH CIVICS. Second, register voters. THIRD, TEACH CIVICS. Rinse. Repeat.

P.P.S.: DEMOCRATS (AND PROSPECTIVE CANDIDATES FOR OFFICE) NEED TO HAVE “TOWN HALLS” IN REPUBLICAN DISTRICTS - ASAP. YOUR OPPONENTS HAVE WILLINGLY CONCEDED THE FIELD.

My hope and encouragement is for citizens to realize they have a right to petition. And that several hundred signatures on a petition is a very loud voice. And that they can petition FOR their representative... THEIR REPRESENTATIVE... who works for them ... will meet in person with them. The "media" will be VERY interested in such a petition.

It requires people working together. The hard work of signing a name to a piece of paper.

How does one promote a non-event in an official way to bring people to an event that will not be happening due to a failure to appear? Does the R rep have to issue a denial of an event that has been promoted and announced by some false "official" announcement? Maybe this should be tried. We have no Rs in Congress in my small blue state, NM.

Expand full comment
Bison Doc's avatar

I'm pretty sure the event will take place, with or without members of Congress. We (several constituents including current and past elected State officials) have issued an invitation to one of our Senators (Daines) to let us know when it would be convenient for him to appear at a town hall so we could arrange a venue. Now, it appears that our efforts have merged with our local Indivisibles who have arranged a venue. The ball is in the Senator's court to respond, and if he doesn't we will have the town hall with at least one empty chair. Or, up to three chairs for our other Senator and Congressional Representative.

See Ali Velshi's detailed reporting on Lawrence O'Donnell show Friday night re: Trump supposedly reining in Musk. Trump is NOT reigning in Musk. In fact, he has threatened his cabinet secretaries to make the cuts themselves or he would tell Musk to do it. But that wasn't all. See the reports leaked from people at the meeting to the NYT. Velshi goes over it line by line.

Expand full comment
Deborah Potter's avatar

I would say that it's wrong because trump IS reining in musk. It is a response to pushback from Senate Majority Leader John Thune and many others in Congress from both parties. trump is saying that musk/DOGE is not authorized to make the cuts, only to be an adviser to the Cabinet Secretaries. That is a demotion.

I would like to hear an explanation also. Since I basically think Trump is focused on looting our country as Putin did to Russia, and having people grovel like they do to Kim Jong Un and Musk hell bent is on corruption and his dictatorship dreams - replacing every government agency with a business he owns -- I hardly know what to make of the reining in of the reigning.

I organized a grassroots coalition to rally in front of my Long Island R Congressman’s office. We held the rally yesterday (Hopium Day).

Simon we had 400-500!!!!!!!!!! people show up!!!!! Rep. Garborino has never had a crowd at his office like that. He touts how bipartisan he is. F that shit he is a Trump enabler just like the rest of the spineless Republicans.

I spoke first.

I began with:

We are Americans & we are here because we love our country! (Crowd roared)

We oppose DOGE takeover!

We oppose cutting Medicaid to fund tax cuts for the rich!

We want an in person town hall!

There were speakers, music and chants. We collected hundreds of signatures demanding an in person town hall and delivered them to the staffer.

The local news came and the rally has been on the news today on a loop!

I’ve never done this before. But I’m here, now, just like all of us in the Hopium community and across the country. And we’re already planning a town hall for our rep who will not show. Together we will win!
