Another Court Delivers Another Blow to Trump - The Colorado Supreme Court’s decision to bar Trump from the ballot in 2024 is a momentous decision, one which I’ll admit I’m ambivalent about. I think we need to take Trump on in 2024 and beat him decisively, and not allow him to claim somehow the election was rigged and our victory illegitate. But here are we, and the now the decision will head to the Supreme Court for a rapid review.
However the Supreme Court rules the Colorado decision is another remarkable legal blow to Trump and MAGA more broadly. Let’s review now the progress being made in the courts against the Trump and MAGA:
Last week Rudy Giuliani was ordered to pay $148 million (!!!!!!!!) for spreading lies about the 2020 election, endangering the lives of two elections workers
GOP leaders in AZ, GA, MI, NV have been indicted for their efforts to interfere with and overturn the 2020 election. Some have plead guilty and are cooperating with prosecutors. Republican leaders in WI who participated in these schemes have struck a deal with prosecutors, admitted their wrongdoing and are now cooperating. Prosecutors in New Mexico have also begun an investigation in GOP leaders who worked to overturn the 2020 election
Over 1,200 people have been successfully prosecuted for crimes related to the violent attack on the Congress on January 6th
Trump has been found to have attempted to rape E. Jean Carroll in a department store changing room, and ordered to pay $5,000,000 in penalties
Trump has been found to have committed financial fraud in New York State, and his trial, which wraps up in mid-January, is about how much he pays not whether he is liable
Trump has been found to have committed insurrection, and has been barred from the 2024 ballot in Colorado
To repeat, courts have *already found* that Trump attempted to rape someone in a department story, commited a massive financial fraud and led an insurrection against the United States. Significant stuff, particularly as we know from polling that the idea that Trump has been convicted, found guilty of a crime, hurts him with voters. And it could get much much worse next year for him and the GOP, as the convictions in this vast conspiracy involving hundreds of leaders of the Republican party to overturn an election and end American democracy continue to mount, and other legal judgments are handed down. And yes, remarkably, the Supreme Court could decide to bar him from the ballot in 2024 in the next few weeks - though it is hard to imagine this corrupt, horrible Court going through with it.

We got some clarity this week on one of the biggest mysteries of the January 6th attack on the US Congress - how in the world did the Park Service grant Trump’s team a permit to hold their rally/march on Federal land? Turns out they lied to the Park Service to get the permit. I will admit, even for MAGA, this is pretty shocking stuff. From the NYTimes:
A pro-Trump group that organized the “Save America” rally in Washington on Jan. 6, 2021, lied to federal officials about President Donald J. Trump’s plans to call on the crowd to march to the Capitol, where the protest over his election loss turned into a violent riot, according to a new inspector general investigation.
Nearly three years after the mob laid siege to Congress, halting the certification of Mr. Trump’s electoral defeat and injuring more than 150 police officers, the Interior Department’s inspector general on Monday released a 47-page report examining the permitting process that allowed tens of thousands of Trump supporters to gather in Washington before the violence.
The report found that Women for America First, which organized a rally at the Ellipse about two miles from the Capitol on Jan. 6, “intentionally failed to disclose information” to the National Park Service “during the permitting process regarding a march to the U.S. Capitol.”
According to the investigation, Women for America First, which is run by Amy and Kylie Jane Kremer, a conservative mother-and-daughter team, repeatedly told Park Service officials there would be no march to the Capitol while privately planning for one.
When shown private text messages indicating there would be a march, a park ranger involved in the permitting process told investigators it “bl[ew her] mind,” the report said. The Park Service had repeatedly asked Women for America First whether there would be a march, and the organization “was just adamant there was gonna be no march.”
A White House liaison to the rally organizers sent a text message on Jan. 3 to Women for America First regarding a demonstration at the Ellipse. “POTUS expectations are intimate and then send everyone over to the Capitol,” the message said, according to the report.
Katrina Pierson, a Trump spokeswoman, had sent an email on Jan. 2, 2021, with nearly identical language.
Also on Jan. 3, Women for America First, which had received a permit on Jan. 1 for a 5,000-person rally, expanded the number of attendees to 30,000 while continuing to deny to Park Service officials that there would be a march.
On Jan. 4, Kylie Jane Kremer wrote in a text message: “POTUS is going to have us march there/the Capitol.” She added: “It can also not get out about the march because I will be in trouble with the National Park Service and all the agencies, but POTUS is going to just call for it ‘unexpectedly.’”
Shown the texts by the inspector general’s office, a National Park Service permit specialist put it this way: “So, um, basically she lied to all of us,” according to the report.
Trump’s Attack On The ACA Is A Huge Blunder - I got to weigh in on Trump’s recent attacks on the ACA in a smart new National Journal piece by George Condon:
Simon Rosenberg, a veteran Democratic campaign strategist, has seen this show before. He was working at the Democratic Congressional Campaign Committee in 2018 after the last repeal attempt. “We’ve litigated the ACA,” he said. “The central reason the Republicans lost the House in 2018 was over their attempt to repeal the ACA.” He added, “These issues around health care and reproductive rights have become central to our politics now. So for the Republicans to dive in and throw fuel on that fire seems wildly reckless and dangerous for their own prospects next year.”
